These Terms and Conditions (“Terms”) govern your use of the Travel Safely RSA mobile application (“the app”), the Business Portal website at www.travelsafelyrsa.co.za (“the website”), and any related services (together, “the platform”). By downloading the app, accessing the website, or registering as a business, you agree to these Terms in full. If you do not agree, do not use the platform.
1. Use of the Platform
Travel Safely RSA is a community-driven road safety platform. The app is available for download worldwide; however, safety markers may currently only be placed at locations within South Africa. You may use the platform only for lawful purposes and in accordance with these Terms. You must not use the app while operating a motor vehicle — always pull over safely before interacting with the app.
2. App User Accounts
- You must be at least 18 years of age to create an account.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must not share your account, create multiple accounts, or impersonate another person.
- You must provide accurate information when registering and keep your account details up to date.
3. Community Content
You are solely responsible for any markers, comments, confirmations, or reviews you submit. By submitting content you confirm that:
- The information is accurate and relates to an actual road safety situation you have directly observed.
- The content does not contain false, misleading, defamatory, offensive, or unlawful material.
- The content does not include URLs, advertising, spam, profanity, or sexually explicit material.
- You grant us a non-exclusive, royalty-free licence to display, distribute, and moderate your content within the platform.
We reserve the right to remove any content that violates these Terms without prior notice.
Safety markers may currently only be placed at locations within South Africa. Marker submissions outside South Africa are not permitted and will be rejected.
3A. Community Place Suggestions
You may suggest a place to be added to the City Guide. A suggestion must be selected from Google Places and contains only a name, category, and location. Suggestions are held for review and are not published until an administrator approves them. By submitting a suggestion you confirm that:
- The place is a real, currently operating business or a genuine public place of interest — not a private residence or a place that no longer exists.
- You are not impersonating the business and are not submitting the entry to mislead, harass, damage, or gain unfair advantage over it or anyone else.
- The suggestion is not spam, advertising, or a duplicate of a place already in the guide.
- You grant us a non-exclusive, royalty-free licence to display, adapt, and moderate the suggested listing within the platform.
An approved suggestion appears as an unclaimed “community” listing showing only the name, category, and address. The business it refers to may later claim the listing through the Business Portal. We may reject, edit, or remove any suggestion or resulting listing at our discretion, and may suspend or ban users who repeatedly submit content that breaches these Terms. Every community listing includes an in-app option to report it and to hide listings from a particular contributor; concerns may also be sent to hello@travelsafelyrsa.co.za.
3B. Route Hazard Notifications
You may switch on hazard alerts for a route you have saved. If you do, we will attempt to notify you when a caution, unsafe, accident, or roadworks marker is added on or near that route. These notifications are a convenience only: they are community-generated, may be delayed, incomplete, inaccurate, or not delivered at all, and must never be relied on for your safety or as a substitute for staying alert to your surroundings. You can turn them off per route at any time, and delivery also depends on your device and operating-system notification settings.
4. Business Listings — Registration and Trial
Businesses may register for an enhanced listing via the Business Portal on our website. By submitting a registration, you confirm that:
- You are authorised to represent the business you are registering.
- All information provided is accurate, complete, and relates to a legitimate South African business.
- You will notify us promptly of any changes to your business details.
Upon successful registration, you will receive a free 3-month trial of the enhanced listing service. The trial begins on the date your listing goes live. No payment is required during the trial period.
5. Business Listings — Subscriptions and Billing
- Monthly subscription: R250 (ZAR) per month, billed in advance. Payment is due at the start of each billing cycle.
- Annual subscription: Available at a discounted rate. Contact us at hello@travelsafelyrsa.co.za for annual pricing.
- All prices are inclusive of VAT where applicable and are quoted in South African Rand (ZAR).
- Billing arrangements are confirmed by email following the end of your trial period. You will be notified at least 14 days before your trial expires.
- We reserve the right to adjust subscription pricing with at least 30 days’ notice to active subscribers.
6. Business Listings — Cancellation and Lapsing
- You may cancel your subscription at any time by contacting us at hello@travelsafelyrsa.co.za. Cancellation takes effect at the end of the current billing period. No partial refunds are issued.
- If payment is not received within 14 days of the due date, your enhanced listing will be suspended. Your listing will revert to a basic unclaimed entry — it remains visible to app users but without photos, enhanced contact details, opening hours, and reviews.
- You may reactivate your subscription at any time to restore your enhanced listing. Historical reviews are retained during suspension.
7. Business Dashboard and Login Credentials
- Business login credentials are issued to the email address provided at registration. You are responsible for keeping these credentials secure.
- You must not share your business login or permit unauthorised persons to manage your listing.
- If you suspect your credentials have been compromised, contact us immediately at hello@travelsafelyrsa.co.za.
- We reserve the right to suspend or revoke dashboard access if misuse is suspected.
8. Accuracy of Information
Safety markers, place listings, community place suggestions, and business listings are submitted by community members or businesses and are not independently verified by us. Route hazard notifications are generated automatically from that community content. We make no warranty as to the accuracy, completeness, timeliness, or delivery of any content or notification on the platform. Always exercise independent judgement and follow official road safety guidance.
9. Prohibited Conduct
You must not:
- Submit false, misleading, or fabricated safety markers or business information.
- Suggest a place that does not exist, is a private residence, is a duplicate, or is submitted as spam, advertising, or to mislead or harm the business or another person.
- Attempt to manipulate the marker trust score or reporter reputation system.
- Use automated tools, bots, or scripts to interact with the platform.
- Attempt to access, reverse-engineer, or interfere with the platform's underlying infrastructure.
- Use the platform to harass, threaten, or harm other users or businesses.
10. Limitation of Liability
To the maximum extent permitted by South African law, Travel Safely RSA and its developers shall not be liable for:
- Any loss, injury, accident, or damage arising from reliance on community-reported safety markers or business listing information.
- Any interruption, suspension, or termination of the platform or any of its features.
- Any indirect, consequential, incidental, or punitive loss of any kind.
- Loss of subscription fees paid where service interruption is caused by circumstances outside our reasonable control (force majeure).
You use the platform entirely at your own risk.
11. Intellectual Property
All original content, design, code, brand names, and trademarks in Travel Safely RSA are the property of the developers and are protected under South African intellectual property law. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the platform without prior written permission.
Community-submitted content (markers, reviews) remains the intellectual property of the submitting user, subject to the licence granted in clause 3 above.
Business-submitted content (photos, descriptions) remains the property of the submitting business. By submitting content you warrant that you hold all necessary rights to that content and grant us a licence to display it within the platform.
12. Termination
We reserve the right to suspend or permanently terminate any user account or business listing at our sole discretion if these Terms are breached, false information is submitted, abusive behaviour is engaged in, or fraudulent activity is suspected. Termination of a business subscription due to breach does not entitle the business to a refund of any fees paid.
13. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with these Terms or the use of the platform shall be subject to the exclusive jurisdiction of the South African courts. Before initiating formal proceedings, we encourage you to contact us to resolve any dispute informally.
14. Changes to These Terms
We may revise these Terms at any time. Revised Terms will be posted on this website with an updated date. For material changes, app users will be notified by in-app notification and business subscribers will be notified by email. Continued use of the platform after the revised Terms are posted constitutes your acceptance of the changes.
